Court finds Shell Nigeria guilty

A Dutch court has rejected a bid by Nigerian farmers to hold Shell’s parent company responsible for oil damage to their villages, saying that only the Anglo-Dutch oil giant’s Nigerian subsidiary was partly responsible.
On Jan. 29, the court dismissed four out of five allegations against the company but ordered it to pay compensation to one Nigerian farmer.

The landmark case against the Anglo-Dutch firm was brought by four Nigerian farmers, a fisherman and Friends of the Earth.

The level of damages in the case will be established at a later hearing.

The case is linked to spills in Goi, Ogoniland and Oruma in Bayelsa State and a third in Ikot Ada Udo, Akwa Ibom State. The farmers had alleged that oil spills had poisoned their fish ponds and farmland from leaking pipelines.

The judge said Shell Nigeria should have done more to prevent sabotage. The Delta’s clean water and fertile farmland used to produce an abundance of food and a good living for residents. Since oil has poisoned the land and water, people look in vain for jobs with the oil companies and, now impoverished, sometimes siphon oil from the ubiquitous above-ground pipelines.

The only victorious plaintiff, Friday Akpan, told AFP by telephone from Port Harcourt in the Niger Delta: “I am happy about the ruling … The pollution damaged my farmland, so their saying that I won in the case is not a surprise because it is true.”

Akpan, a fish farmer with 12 children, said oil pollution caused his fish to die and that people were scared away by the “smell of dead fish.”

Both sides claimed victory in a case that pressure groups had hoped would set a precedent for global corporate responsibility.

Super Eagles can defeat the Elephants of Ivory Coast with this strategy

The Super Eagles of Nigeria will be taking on the Elephants of Ivory Coast in the third quarterfinal of the African Nation's Cup on Sunday. Many people in Nigeria and beyond believe that this Super Eagles team is not good enough to beat the Ivorians but I disagree. I now present to you my strategy which I strongly believe the Super Eagles can execute to defeat the Elephants...

 

To beat Ivory Coast, the Super Eagles have to adopt the 4-4-2 formation at the beginning of the match. Play a very high line in defence (Yobo should lead the line), then play Mikel, Igiebor, Moses and Emenike as your attacking quartet. This four will press the Ivorians from their half when they are without the ball and will strive to score a goal or two as early as possible in the game.

The orientation of this line-up is attacking through the middle. The Ivorian defence is its weakest link, we need to run at them without fear. The objective is to put the ball in the back of their net as many times as possible not to look at their names or faces.

Once we score and can defend it into the 2nd half, we will change the formation into a modified 4-3-3 formation. It will be 4-4-2 when we defend and 4-3-3 when we attack, at this point the Ivorians will be tiring. We must exploit the spaces at the back of their defence.

Defence
The essence of playing a high line in defence is to use the offside trap as best we can. The Ivorians will have a few chances when they beat the trap but I expect quick recovery times from our defenders and a world class performance from our goalkeeper.

Penalty Kicks
Our team needs to be proficient at taking penalty kicks whilst Enyeama has to get better at stopping them. Players who don't know how to take penalty kicks should be taught how. The easier way to succeed as a penalty taker is to watch the movement of the goal keeper and place the ball in the opposite direction, blindly kicking the ball will mean a higher chance of you missing it or the keeper saving it.

The Ivorians have not won the African Cup of Nations since 1992. Why? Other teams have defeated them, the Super Eagles can do the same.

Negotiation between EFCC and Oil Marketers Over N1.3 billion Fuel Subsidy Scam Breaksdown

N1.3b subsidy scam: EFCC’s negotiation with marketers breaks down


The attempt by two marketers, Aro Sunday Bamidele and Abiodun Kayode Bankole, to negotiate with the Economic and Financial Crimes Commission (EFCC) over the N1.3 billion subsidy fraud preferred against them has failed.

Both marketers are standing trial over their role in the fuel subsidy fraud and obtaining money under false pretense from the Federal Government.

The EFCC had alleged that the defendants had fraudulently obtained N1.3 billion from the Federal Government for the purported importation of 30 million litres of Premium Motor Spirit (PMS).

However, at the resumed hearing of the matter before Justice Lateefa Okunnu of a Lagos High Court sitting in Ikeja on Monday, EFCC counsel, Tayo Olukotun, informed the court that the negotiation process had failed.

“My Lord, I wish to inform the court that negotiations between the parties have broken down. We were informed on Wednesday, January 24 of this development.

“The defendants have filed a Notice of Preliminary Objection, we would like to respond to this and would be applying for a short time to respond,” Olukotun stated.

Justice Okunnu adjourned the matter till February 26 for arguments on the Preliminary Objection.

The oil marketers, alongside their company A.B.S Investment Company Ltd, were among the 13 suspects arraigned by the anti-graft agency on October 5, 2012 for a whopping N3.7 billion fuel subsidy scam.

They are to face 18-count charge bordering on conspiracy, obtaining money by false pretence, forgery and uttering.

The massive fraud was perpetrated using various instrumentalities such as forging of bills of lading, certificate of quantities and certificate of origin among other criminal infractions to fraudulently obtain payments from the petroleum support fund as subsidy for the importation of petroleum motor spirit (petrol).

Rare pygmy elephants 'poisoned' in Borneo

Ten endangered pygmy elephants have been found dead in a reserve in Malaysia, with officials saying they may have been poisoned.

The animals, which had all suffered internal bleeding, were found near each other over the space of three weeks.

In one instance, a three-month-old calf was found alongside the body of its mother, apparently trying to wake her.

Sabah Environmental Minister Masidi Manjun said it was "a sad day for conservation and Sabah".
Sen Nathan, head veterinarian at the Gunung Rara Forest Reserve in Malaysia's Sabah state on the island of Borneo, said the elephants were all thought to be part of the same family group, and were aged between four and 20.

The bodies of four were found last week but then officials found another four animals dead or dying two days later.

Laurentius Ambu, Sabah's wildlife department director, said two "highly decomposed elephant carcasses" had been found earlier in the year.

"We believe that all the deaths of these elephants are related," he said.
The animals still had their tusks, indicating that they had not been killed by poachers, and none had gunshot wounds.

Why send a monkey and not any other animal?

Iran said on Monday it had launched a live monkey into space, seeking to show off missile systems that have alarmed the West because the technology could potentially be used to deliver a nuclear warhead.

The Defense Ministry announced the launch as world powers sought to agree a date and venue with Iran for resuming talks to resolve a standoff with the West over Tehran's contested nuclear program before it degenerates into a new Middle East war.

Efforts to nail down a new meeting have failed repeatedly and the powers fear Iran is exploiting the diplomatic vacuum to hone the means to produce nuclear weapons.

The Islamic Republic denies seeking weapons capability and says it seeks only electricity from its uranium enrichment so it can export more of its considerable oil wealth.

The powers have proposed new talks in February, a spokesman for the European Union's foreign policy chief said on Monday, hours after Russia urged all concerned to "stop behaving like children" and commit to a meeting.

Iran earlier in the day denied media reports of a major explosion at one of its most sensitive, underground enrichment plants, describing them as Western propaganda designed to influence the nuclear talks.

The Defense Ministry said the space launch of the monkey coincided "with the days of" the Prophet Mohammad's birthday, which was last week, but gave no date, according to a statement carried by the official news agency IRNA.

The launch was "another giant step" in space technology and biological research "which is the monopoly of a few countries", the statement said.

The small grey monkey was pictured strapped into a padded seat and being loaded into the Kavoshgar rocket dubbed "Pishgam" (Pioneer) which state media said reached a height of more than 120 km (75 miles).
"This shipment returned safely to Earth with the anticipated speed along with the live organism," Defense Minister Ahmad Vahidi told the semi-official Fars news agency. "The launch of Kavoshgar and its retrieval is the first step towards sending humans into space in the next phase."

There was no independent confirmation of the launch.

Director jailed 2yrs for stealing N33bn pension fund freed on N250,000 fine 

Activist says the N250 thousand fine in a monumental pension fraud is a “handshake”

An Abuja court on Monday handed a two year jail term, with a N250,000 fine option, to one of six federal officials tried for stealing N32.8 billion of police pension fund.

The sentencing is the first conviction in an elaborate scam that came to light early 2012 involving several top officials, offices and banks.

John Yakubu Yusuf, a former assistant director in the federal civil service, was tried on a 20-count charge alongside Atiku Abubakar Kigo (Permanent Secretary), Ahmed Inuwa Wada (Director), Veronica Onyegbula (Cashier) and Sani Habila Zira (ICT Officer).

Mr. Yusuf’s sentencing came after he pleaded guilty to betraying trust and fraudulently converting N2 billion of police pension funds to private use. The trial continues for the other accused.

Mr. Yusuf admitted to the 19th and 20th offences relating specifically to him, each involving betrayal of trust and the conversion of N1 billion apiece. The maximum penalty for the offence is two years.

Mr. Yusuf is to forfeit property traced to him by the Economic and Financial Crimes Commission, EFCC, valued at N325 million.

Copyright haven: Caribbean islands get approval to engage in what US calls 'authorized piracy'

The Americans call it piracy. The Antiguans call it justice.

The islands of Antigua and Barbuda are threatening to strip intellectual property protections from American goods in retaliation for a U.S. embargo on the tiny Caribbean nation's online gambling industry.

U.S. officials say that the proposed copyright haven — whose broad outlines were approved Monday at the World Trade Organization in Geneva — amounts to "government-authorized piracy."

But Antiguans, who've won a series of legal victories against the U.S. at the international trade body, say they're within their rights so long as Washington maintains its online gambling block.

What such a haven might look like is unclear. There's little in the way of precedent for Antigua's move, and the islands still hope for a negotiated settlement to the dispute.

Egyptian ref, Grisha, sacked from Cup of Nations
Egyptian referee, Ghead Grisha, who was at the centre in the Group C match between Nigeria and Cup holders Zambia in Nelspruit on Friday, has been sacked from the 29th Africa Cup of Nations.

Grisha hugged the headlines on the negative side when he awarded a highly controversial penalty against the Super Eagles four minutes from time, which enabled the champions to draw level in the game at Mbombela Stadium.

A top official of the Confederation of African Football confirmed on Sunday that the 36-year old, who became an international referee in 2008, will take no further part in the on-going championship in South Africa.

“He has been sent home. He will have no further action at this Cup of Nations. His decisions did not tally with best practices of the refereeing profession and we would not allow anyone to start re-writing the rules of the game here,” said the official.

Caf’s decision came as the Super Eagles settled down at their Hunters’ Rest abode in Rustenburg, ahead of Tuesday’s must-win final Group C clash with the Walya Antelopes of Ethiopia at the Royal Bafokeng Sports Palace.

15,000 Crocodiles Escape Farm Into South African River

A South African crocodile farm is facing a large problem after 15,000 of the animals escaped from the site and made their way into the nearby Limpopo River. The crocs made their dash for freedom when massive floodwaters forced the farmers to open their gates in an effort to avoid those waters from crushing the walls of the enclosures. Most of the animals made their way to the wild bush along the river, which could serve as the perfect home for the massive predators.

A spokesperson for the farm says that they have managed to capture several thousand of the runaway crocs, but they estimated that about half of the escapees were still at large. The farm staff is rounding them up as quickly as they can, but considering the large number of animals that escaped, it is a challenging job.


The escaped crocs are all Nile
crocodiles, the species that is most common in Africa. Capable of growing up to 18 feet in length and weighing as much as 1700 pounds, they are the largest freshwater crocs in the world. They are also known for being voracious predators, attacking nearly any other animals (including humans) that wander into or near the waters where they make their home.

The Limpopo River is one of the great waterways of southern Africa, meandering for more than 1000 miles across the region. The river flows into
South Africa's northeast corner along the border of its famous Kruger National Park, a remote wilderness that would provide plenty of prey for the escaped crocs. The predators are not unknown to the Limpopo, but until now their numbers have been relatively small. That could change if these animals are not rounded up.

Egypt: Deadly clashes follow soccer riot verdict

The director of hospitals in Egypt's Mediterranean city of Port Said says two soccer players are among the 27 people killed in riots there.

Violence erupted in Port Said after a judge sentenced 21 people to death in connection with a Feb. 1 soccer melee that killed 74 fans of the Cairo-based Al-Ahly team.

The security officials say most were killed in assaults on the governor's office, courthouse and prison after the sentence was handed down during a trial outside Cairo. They say two policemen also were shot to death outside the city's main prison when angry relatives tried to storm the facility.

Dr. Abdel-Raham Farah says Mahmoud Abdel-Halim al-Dizawi, a soccer player in Port Said's Al-Marikh club, was shot three times and died.

He says Tamer al-Fahla, a soccer player who used to play for the city's main Al-Masry team, was also shot dead on his way to Al-Marikh club.

The club is near a prison which residents tried to storm Saturday to free defendants in the soccer trial. The military has been deployed to try and restore security.

CBN Set New Rules For Banking

The policy pegs a maximum single deposit amount of N20,000 and maximum cumulative balance of N200,000 at any point in time on the Low Value Account.
It also places a maximum single deposit of N50,000 and a maximum cumulative balance of N400,000 on the Medium Value Account. However for the High Value Account, no limit is placed on cumulative balance.
The policy also categorized bank customers into Low Value Accounts (level one); Medium Value Accounts (level two) and High Value Accounts (level three).
In a circular to all banks and other financial institutions the Apex Bank explained that the policy became exigent after the CBN recognized that access to basic banking facilities and other financial services is necessary in achieving the policy on financial inclusion.
